By using the services provided by Hostragons Global Limited (hereinafter referred to as "Hostragons"), you are deemed to have fully accepted the terms outlined in this agreement for all transactions made through the website www.hostragons.com (hereinafter referred to as the "Website"). Hostragons, the creators of the Website's content, its employees, and individuals or organizations authorized by Hostragons bear no criminal or legal liability for any material or moral damages that may arise from your failure to read or comply with these terms.

Article 1 – Contract Amendments Hostragons Global Limited reserves the right to update or modify this agreement unilaterally at any time without prior notice.

Article 2 – Accuracy of Information and Content The information, statistical data, and evaluations on the Website are compiled from generally accepted reliable sources. However, the accuracy and adequacy of this information are not guaranteed by Hostragons Global Limited. Hostragons assumes no personal, legal, or criminal liability for any direct or indirect material and/or moral damages, or any other potential losses and expenses that may arise from the use of the information, evaluations, comments, and statistical data on the Website.

Article 3 – Warnings and Declarations It is assumed that you have read and accepted the warnings and declarations in this agreement before obtaining services from Hostragons Global Limited. In the event of any dispute, claim, or demand, the statements on this webpage and all other computer records belonging to Hostragons will be considered the sole and exclusive evidence. All individuals and organizations accepting these terms are deemed to have accepted and committed to these conditions when accessing the Hostragons Website.

Section 1 – Orders and Service Delivery

1.1. Order Confirmation and Account Setup Your order will be processed after successfully passing fraud checks and once your payment is approved. Once your account setup is complete, the necessary information will be sent to you via email.

1.2. Payment Methods and Setup Times

  • Credit Card Payments: Payments made via credit card typically result in the automatic setup of domain names, web hosting, and reseller hosting accounts. However, due to potential technical issues, the setup time may extend up to 48 hours.
  • Bank/Wire Transfer Payments: For payments made via bank transfer or EFT to our bank or postal check accounts, the setup time is a maximum of 2 business days.
  • VDS and Dedicated Servers: The standard setup time for VDS and dedicated server services is 72 hours unless otherwise specified.
  • Software and Licensing Services: The delivery time for software and licensing services is a maximum of 1 week unless a specific time is specified.

1.3. Refund Policy If the service delivery does not occur within the specified timeframes, your payment will be refunded upon request.

1.4. Email Communication and Responsibilities

  • Email Address: You are required to provide an active and accessible email address during the order process. This email address will be used for communication and informational purposes.
  • Email Update: It is your responsibility to keep your email address up-to-date and check it regularly. Emails sent are assumed to have been delivered, and Hostragons cannot be held liable for any damages resulting from undelivered or unread emails.

4.5. Price Changes Hostragons reserves the right to change product and service prices without prior notice.

1.6. Security Checks As part of security requirements, Hostragons may request a photocopy of your credit card or ID. If these documents are not provided, your order may be canceled or your services suspended. For accounts suspended due to fraud suspicion, Hostragons reserves the right not to issue a refund or to issue a partial refund.

Section 2 – Website Migration

2.1. Migration Service In cases where Hostragons provides a guaranteed site migration service, every effort will be made to transfer your site to Hostragons. However, as the migration process is complex, no guarantees can be made regarding the duration or success of the migration.

2.2. Migration Process and Responsibilities Each hosting company has different configurations, and in some cases, it may be difficult or impossible to transfer your site completely and without errors. Hostragons accepts no legal or criminal liability for incorrect or incomplete migration of your site or if the migration cannot be completed.

Section 2 – Content

2.1. Legal Compliance All services provided by Hostragons are delivered in accordance with the laws of the United Kingdom. Hostragons cannot be held legally responsible for any actions taken during the use of our services; users assume full legal responsibility for all actions performed while using our services.

2.2. Copyright and Trademark Rights Publishing, distributing, or selling content that violates copyright or trademark rights through our services is prohibited. This includes unauthorized music, books, photos, and other copyrighted materials. As per legal regulations, hosting pornographic/erotic content and content that can be used for hacking purposes is prohibited. If a violation is detected, the relevant content will be deleted or access will be blocked; in case of repetition, services may be suspended or terminated. To report suspicious content, an email can be sent to [email protected]. Hostragons may request additional information or documents regarding complaints.

2.3. Illegal Activities and Complaints Hostragons may not terminate the service in complaints regarding illegal activities if it is not certain whether the activity constitutes a crime. Hostragons does not have the authority to make legal judgments, and in such cases, users are required to seek their rights through legal channels. If you suspect any illegal content is hosted on Hostragons servers, please report it to [email protected].

2.4. Usage Limits and Responsibilities The services provided by Hostragons can only be used within the limits permitted to you. If you access any content, file, or service that you are not authorized to use, you are expected to report it to Hostragons immediately without using it. Otherwise, you will be held responsible for any material or moral damages that may arise from this situation.

2.5. Monitoring and Tracking Hostragons reserves the right to monitor site content and access for legal reasons such as system management, tracking unauthorized access, verifying security procedures, and ensuring operational security. Content and information obtained during monitoring may be tested, recorded, copied, or used for the purposes mentioned above. Hostragons does not use or share the content for purposes other than these.

2.6. Service Provision and Content Removal Hostragons reserves the right to provide or refuse service to anyone at its discretion. It also reserves the right to remove or block access to content that is deemed to be in violation of the agreement, provocative, divisive, illegal, or inappropriate. Regarding such content, Hostragons reserves the right not to issue a refund or to issue a partial refund.

2.7. Harmful Content and Security Uploading harmful content such as viruses or shell scripts that can damage Hostragons servers may result in the termination of your account without a refund. All damages caused to Hostragons or other users by such actions are the sole responsibility of the user who performed them. Users are responsible for the security of their accounts and the safety of the software, scripts, and programs they upload. Users must use strong and unpredictable passwords for their accounts and are accountable for all actions performed within their accounts.

2.8. Modification Requests Hostragons reserves the right to request modifications to any website, database, account, or other materials/services.

Section 3 – SPAM Prohibition

3.1. No Tolerance for SPAM Hostragons has zero tolerance for unsolicited emails, bulk email sending, and SPAM emails. Failure to comply with these rules may result in the termination of the relevant service(s) with or without notice. Services causing our IP block to be listed on email blacklists will be terminated without notice.

3.2. IP Addresses on Blacklists If Hostragons' IP block is listed on email blacklists, the user responsible for this may be charged a fee to remove the IP block from the blacklists. This fee is determined by Hostragons and represents the amount required to clean the IP block from the blacklists. By purchasing services, it is considered agreed that such a fee will be paid without objection and within the requested timeframe in such cases.

4.1. Payment Obligation As long as services are received from Hostragons, it is agreed that the service fee will be paid to Hostragons. Unless the service is canceled, it will be automatically renewed and the relevant invoice will be issued. If you wish to cancel the service, you must submit a cancellation request at least 15 days in advance. The cancellation request must be made through your customer panel.

4.2. Cancellation Procedures Service cancellation must be done through your customer panel. The cancellation page provides the necessary options to cancel the service immediately or upon its expiration.

4.3. Payment Delays and Consequences For accounts not canceled 15 days in advance and with unpaid balances, Hostragons reserves the right to collect fees through legal means. It is the user's responsibility to keep payment information up-to-date and to pay invoices on time. If an invoice is not paid on time, Hostragons may grant a 1-day grace period for web hosting and reseller hosting accounts, after which the service may be suspended. Services may be terminated 15 days after the due date. For domain names, VDS, and dedicated server services, accounts may be terminated immediately if payment is not made on the due date. Hostragons cannot be held responsible for damages or data loss resulting from this situation.

4.4. Overpayments and Credit Overpayments made accidentally or intentionally are added to your account as credit and are non-refundable. This credit can be used for future services from Hostragons.

4.6. Resource Usage and Additional Fees If the purchased disk space, traffic, or similar resources exceed the allocated amount, the cost of the additional resources will be charged to the user. This fee must be paid without objection and within the requested timeframe. If payment is not made, the account may be terminated without a refund, and Hostragons will not be held responsible for any damages or data loss resulting from this situation.

4.7. Refund Requests In cases where refund requests (dispute, chargeback, etc.) are initiated through payment channels without the knowledge or permission of Hostragons, the user is responsible for compensating all material and moral damages incurred by Hostragons.

Section 5 – Backup and Data Loss

5.1. Data Responsibility Users assume full responsibility for their data while using Hostragons services. Hostragons provides a backup service as a convenience for users, but it does not guarantee the accuracy or continuity of these backups. Hostragons cannot be held liable for any data loss that may occur for any reason.

Section 6 – Service Cancellation and Refund

6.1. Service Termination Hostragons reserves the right to terminate any service, with or without notice, without refund or with partial refund, and without providing any reason.

6.2. Inappropriate Behavior Insults or rude behavior towards Hostragons staff may result in the suspension or termination of the associated account or services. In such cases, the membership may be terminated, and the agreement canceled without any refunds.

6.3. Commercial Reputation Users are expected to avoid comments, actions, or statements that could damage the commercial reputation of Hostragons or its employees. In cases of such behavior, the user will be liable for material and moral compensation, and the Istanbul Courts and Enforcement Offices will be considered competent in such cases.

6.4. Compromised Websites Websites that harm servers or cause issues such as slowdowns/outages may be terminated without notice and without any refund. In such cases, Hostragons reserves the right to charge the necessary fees to cover the damages incurred.

6.5. Refund Policy For paid services, if canceled before the service period ends (due to breach of service agreement, user request, etc.), neither the full service fee nor the fee for the unused period will be refunded. Credits in the user account can be used for other services from Hostragons, but no refunds or credits will be issued for early terminated services.

7a – Use of the Service

7aa – Web Hosting/Reseller Hosting

Prohibited Actions:

  • Bulk Email and SPAM: Bulk email sending and SPAM are strictly prohibited. Email services should only be used for normal correspondence.
  • Resource Usage: It is forbidden to use more than resources for more than 90 seconds. Activities such as CGI, FTP, PHP, HTTP may cause resource usage.
  • Average Resource Usage: It is prohibited to use more than %5 per day for web hosting accounts and per day for reseller hosting accounts.
  • Server-Based Programs: Running server-based programs like IRCD is prohibited.
  • Spider/Indexer Programs: Running programs like Google Cash/AdSpy is prohibited.
  • IRC Software: Software that communicates with IRC networks is prohibited.
  • Proxy Applications: Running proxy applications is prohibited.
  • Bit Torrent Applications: Running Bit torrent applications is prohibited. External links to legal torrents are allowed.
  • File Sharing/P2P: File sharing or peer-to-peer applications are prohibited.
  • Game Servers: Game servers such as Counter-Strike and Half-Life are prohibited.
  • Cronjob Applications: Running cronjobs at intervals shorter than 15 minutes is prohibited.
  • File Sharing Software: File sharing software such as Dosya.tc and Mediafire is prohibited.
  • Audio/Video Broadcast: Audio streaming or video broadcast applications are prohibited.
  • File Limit: Each web hosting account is limited to a maximum of 200,000 files. Accounts with more than 100,000 files will not be backed up.

7ab – VDS/Dedicated Server

Prohibited Actions:

  • Bulk Email and SPAM: Bulk email sending and SPAM activities are prohibited.
  • Excessive Resource Usage: Excessive resource usage that may harm other VDS instances is prohibited.
  • Proxy Applications: Running proxy applications is prohibited.
  • Bit Torrent Applications: Running Bit torrent applications is prohibited.
  • File Sharing/P2P: File sharing or peer-to-peer applications are prohibited.
  • Malicious Usage: Usage for attacks such as DDoS and Botnets is prohibited.

Section 7b – Backup Limit

Customers who perform continuous and unnecessary backups may have their services suspended or terminated, with or without notice. This applies when the backup service is misused and causes harm to the server.

Section 7c – Unlimited Web Hosting

  • Usage Scope: Unlimited web hosting can only be used to host your website files and cover your website traffic.
  • Data Storage/Backup Space: Unlimited web hosting space cannot be used for data storage or backup purposes.

Section 8 – Traffic Usage

8.1. Traffic Limit and Monitoring If you exceed the traffic limit specified in your purchased package, the relevant service or services may be automatically suspended until the start of the next month or until additional traffic is purchased. Monitoring the traffic used is the user's responsibility, and unused traffic cannot be carried over to the next month.

8.2. Overage Fees Usage exceeding your monthly traffic limit will be billed in the following month. This fee must be paid without dispute and within the specified timeframe.

9.1Uptime Commitment If the uptime guarantee promised by Hostragons cannot be provided, upon request of users, one month of free usage for the relevant service may be provided. Hostragons keeps uptime reports through its own systems and reports from third-party monitoring software other than these reports are not valid.

9.2. Scope and Exceptions of the Guarantee The uptime guarantee does not apply during malicious attacks or scheduled server maintenance. Such interruptions are not included in the uptime rate.

9.3. Uptime for VDS and Dedicated Servers The uptime guarantee for VDS and dedicated server services applies only to network connectivity. The server's operational state is not Hostragons' responsibility, and Hostragons may not be aware of any issues unless reported by the user. Discounts provided under the uptime guarantee do not include third-party software and license fees.

Section 10a – Scope of Support

Hostragons provides support only for the services offered. User operations and software support are outside the scope of hosting services. For VDS/dedicated server services, support only covers restoring the system to its initial delivered state. For software services, Hostragons is only responsible for delivering fully functional software.

Section 10b – 24/7 Support and Support Response Time

24/7 support indicates that our support team operates without being limited to business hours. Support requests are responded to within a maximum of 24 hours, depending on the workload.

Section 11 – Reseller Hosting: Customer Responsibility

Reseller hosting users are responsible for providing support to their own customers. Hostragons does not provide support to the customers of reseller users. Reseller users are accountable for the content of their customers and cannot hold Hostragons responsible for any illegal or contract-violating activities of their customers.

Section 12 – VDS and Dedicated Server

In VDS and dedicated server services, the right to reset passwords is reserved. Users are responsible for maintaining a valid email address and root password registered in the system. Backups are the user's responsibility.

Section 13 – Co-Location (Server Hosting)

In server hosting services, the right to reset passwords is reserved. In case of payment delays, hosted servers and equipment may be held as collateral until payment is made.

Section 14 – Additional Services Agreement

14.1 WordPress Optimization Service Hostragons provides technical optimizations to enhance the performance and security of your WordPress site. The customer is responsible for providing Hostragons with the necessary access information. Hostragons is not liable for any issues arising from changes made to the customer’s site. Optimization services are carried out based on the current state of the site and best practice standards determined by Hostragons.

14.2 Server Optimization Service Hostragons provides necessary optimizations to enhance the performance and security of your server. The customer must provide server access information and necessary permissions to Hostragons. Hostragons is not responsible for server issues arising from the customer's own actions.

14.3 Google Ads Optimization Service Hostragons provides consultancy services for the optimization of your Google Ads campaigns. The customer must collaborate with Hostragons regarding ad content and goals. Hostragons does not take responsibility for the management of the customer's ad budget.

14.4 Organic Traffic Service Hostragons provides services to attract organic traffic to your website. The customer is responsible for the site's content and SEO optimization. Hostragons is not responsible for the conversions resulting from traffic attraction.

14.5 CloudFlare Optimization Service Hostragons provides speed and security optimization for your site through CloudFlare. The customer must provide CloudFlare account information and necessary permissions to Hostragons. Hostragons is not responsible for issues arising from the use of third-party services.

14.6 VPN Service Hostragons provides VPN services for secure internet access. The customer is responsible for using the VPN service within the legal framework. Hostragons is not responsible for the actions performed by the customer while using the VPN service.

14.7 DNS Service Hostragons provides DNS management and optimization services. The customer is responsible for domain management and the proper configuration of DNS settings. Hostragons is not responsible for issues arising from the misuse of the DNS service.

14.8 Mail Hosting Service Hostragons provides professional email communication solutions. The customer is responsible for managing email traffic and implementing security measures. Hostragons is not liable for issues arising from the customer's email content and usage.

14.9 CDN Service Hostragons provides CDN services to distribute your content faster and more securely to users worldwide. This service enhances your website's performance while providing additional protection during high traffic periods and DDoS attacks.

  • Service Scope: Hostragons distributes the customer's content through a global CDN network. This service aims to reduce content loading times and improve user experience.
  • Customer Obligations: The customer agrees to comply with all applicable laws while using the CDN service. The customer also guarantees that the content distributed via the CDN is in compliance with copyright and other intellectual property rights.
  • Performance Guarantee: Hostragons guarantees a certain percentage of uptime and may provide specific credits to the customer if this target is not met.
  • SLA Exclusions: Planned maintenance, events outside the customer's control, and situations beyond Hostragons' reasonable control are excluded from the SLA.
  • Legal Compliance: The customer agrees to comply with all applicable laws and regulations during the use of the CDN service. Hostragons reserves the right to provide any requested information to legal authorities.

Section 15 – Price Changes

The price will not be changed during the purchased service period unless additional features are purchased or usage exceeds the limits. Hostragons reserves the right to change the prices at the end of the service period.

16a. Indemnification You agree to indemnify Hostragons against any claims, damages, or expenses arising from your use of the services or violation of these terms.

By using services from Hostragons, you agree not to harm Hostragons and to indemnify for any damages that may occur.

Section 16b – Legal Obligations

You agree not to impose any legal obligations on Hostragons. In the event of any legal situation, you commit to covering the court and attorney fees.

Section 17 – Waiver

Hostragons cannot be held liable for damages to your business and does not provide warranties regarding its services. It cannot be held responsible for data losses, delays, interruptions, or inaccurate information delivery.

Section 18 – Legal Disclosure

Hostragons is required to provide information requested by legal authorities, which may include your private data.

Section 19 – Addendum

19.1. Privacy and Personal Data Protection Hostragons places great importance on the privacy and protection of users' personal data. User data will be processed and protected in accordance with applicable data protection laws.

19.2. Intellectual Property Rights Hostragons does not claim any intellectual property rights over users' content. Users declare and warrant that they own the intellectual property rights to the content they upload or have permission to use these rights.

19.3. Service Changes Hostragons reserves the right to make changes to its services and technological infrastructure in line with advancements. Such changes will be made to enhance service quality.

19.4. Third-Party Services Hostragons may integrate third-party services as part of its offerings. The use of these services is subject to the terms of service of the respective third-party provider.

19.5. Limitation of Liability Hostragons does not accept responsibility for indirect, special, incidental, or punitive damages arising from the use of its services.

19.6. Service Continuity Hostragons will make reasonable efforts to ensure service continuity but does not guarantee uninterrupted or error-free service.

19.7. Legal Compliance Hostragons takes all necessary measures to comply with legal regulations and industry standards.

18.8. Dispute Resolution Any disputes between Hostragons and its users will first be attempted to resolve in good faith, but if no resolution is reached, they will be resolved under the laws of the country where Hostragons is located.
